$4 Million Settlement After Sacramento County CPS Ignored Ten Abuse Reports Against Tortured Teen

For seven years, beginning when he was a young child, Kyle Ramirez endured relentless abuse inside two California homes, first in Sacramento County and then in Tracy. His caregiver and three other adults burned him with bleach, shackled him with chains, and beat him with weapons on a near-daily basis. Neighbors, teachers, and others filed at least ten separate abuse reports with Sacramento County Child Protective Services during that period.

CPS social workers failed to act on each of those reports. According to the lawsuit, workers repeatedly violated state law and their own internal protocols, did not investigate allegations within required timeframes, failed to notify law enforcement, and never filed a missing-person report when the boy disappeared from their caseload. The agency's inaction allowed the abuse to continue for years after the first report was received.

In 2008, Kyle escaped by jumping on a trampoline over a fence and running to a nearby fitness center. He arrived emaciated, bruised, and still wearing a shackle on his ankle. Four perpetrators, including his legal guardian Caren Ramirez, were subsequently convicted; three received sentences of 30 to 34 years in prison, and a fourth, a neighbor found guilty at trial, was sentenced to life.

Attorney John Demas of Demas Law Group filed a government tort claim against Sacramento County on Kyle's behalf in February 2011, then pursued the civil lawsuit after the county rejected it. The case centered on the county's obligation to protect a child who was actively on its radar, documented repeatedly, and still left in danger.

In July 2015, Sacramento County agreed to settle for $4 million. John Demas stated at the time that the amount could be the largest CPS settlement in California history, describing it as reflecting how severely the agency mishandled the case. The four perpetrators remain incarcerated, and the settlement resolved Kyle's civil claims against the county.
