Bexar County Jury Awards $1.985 Million After Danco Construction Truck Driver Collides with Michelle Gibbons

Michelle Gibbons was driving in Bexar County when her vehicle was struck in a multi-vehicle collision involving a truck operated by Samuel Reyna Montalvo, who was working for Danco Construction, Inc. at the time. The crash left Gibbons with spinal injuries and bodily harm that required medical treatment and disrupted her daily life. She filed suit in 2020 (Cause No. 2020CI23307) against both Reyna Montalvo and Danco Construction in the 73rd Judicial District Court of Bexar County.

Plaintiff's attorneys Alexander Begum and Negin Roberts built the case around the driver's conduct and Danco Construction's responsibility for the actions of its employee. The defense disputed liability and contested the extent of Gibbons's claimed injuries. Judge Angelica Jimenez presided over the trial.

On March 21, 2024, the jury sided with Gibbons and returned a verdict of $1,985,430.80, which ranked as a top truck-accident verdict in Bexar County for the year. The award covered past and future medical expenses, physical pain and suffering, and related damages from the collision.

Danco Construction and Reyna Montalvo filed a motion for new trial in April 2024, then noticed an appeal on June 20, 2024, to the Texas Fourth Court of Appeals (No. 04-24-00413-CV). Briefing was completed by March 2025 and the court denied oral argument. On August 27, 2025, the Fourth Court issued a memorandum opinion reversing the trial court's judgment and remanding the case for further proceedings. As of that date, no final judgment had been reinstated, and the matter was returned to the 73rd District Court.
