What happened
The collision happened on a Connecticut road when a limousine driver drifted out of his lane and struck a motorcyclist traveling in the adjacent lane. The impact threw the rider, leaving him with a fractured skull, a traumatic brain injury, and additional injuries that doctors described as life-threatening. He required emergency care and faced a prolonged recovery from the neurological damage alone.
The central liability question was straightforward in theory but required documentation to prove in practice: the limo driver had no legitimate reason to be in the motorcyclist's lane. Blake Driscolli, a trial attorney at Trantolo and Trantolo, built the case around the driver's improper lane change, gathering evidence that showed the motorcyclist had been traveling lawfully and had no opportunity to avoid the collision.
Because the injuries were catastrophic, the focus shifted quickly to insurance coverage. Driscolli pursued the full policy limits available on the limousine driver's coverage. The case did not go to trial. The defendant's insurer agreed to pay out the entire available policy, $1.25 million, in a pre-trial settlement.
