Parking-Lot Crash Yields $591,560 Jury Award for Austin Plaintiff

On July 31, 2021, Steven Gambler was involved in a parking-lot automobile collision in the Austin area. The at-fault driver, Huber Javier Tinoco, was operating a vehicle in connection with All Pro Restoration Inc., doing business as Servicemaster Restoration by All Pro. Erick Mondragon Jaimes and the parent franchise entity Servicemaster Clean/Restore Spe LLC were also named as defendants.

Gambler suffered injuries affecting him physically and psychologically in the months that followed. The defendants did not contest liability at trial, so the case before a Travis County jury was limited solely to the question of damages. Judge Jessica Mangrum presided over the six-day trial in the 200th Civil District Court, which ran from June 4 through June 10, 2024.

Cole Gumm of Zinda Law Group presented evidence of Gambler's past and ongoing losses across eight categories. Eleven jurors returned a verdict that separated the damages with specificity: $83,360 for past physical pain, $64,240 for future physical pain, $64,240 for past mental anguish, $32,120 for future mental anguish, $83,360 for past physical impairment, $64,240 for future physical impairment, $90,000 for past medical expenses, and $110,000 for future medical care. The jury awarded nothing for future disfigurement.

The total award came to $591,560. Defense counsel J. Hampton Skelton of Skelton and Woody, PLLC represented the defendants. No post-trial reduction or appeal has been reported in publicly available records.
