What happened

On the night of October 1, 2017, a gunman opened fire from a room on the 32nd floor of the Mandalay Bay hotel in Las Vegas, Nevada, raking an outdoor country music festival below. The attack killed 58 people and wounded hundreds more, making it the deadliest mass shooting in modern American history. The Route 91 Harvest festival drew a crowd of roughly 22,000 concertgoers who had no reason to expect the catastrophic violence that unfolded.

In the aftermath, thousands of survivors and family members sought legal recourse against MGM Resorts International, the owner of Mandalay Bay. Their central claim was that MGM, as the property owner, bore a duty to detect and prevent the kind of threat that materialized that night. The litigation consolidated into a federal multi-district proceeding, drawing law firms from across the country representing different groups of claimants.

In October 2019, the parties reached a settlement valued between $735 million and $800 million, with the final amount tied to the proportion of claimants who opted in. A federal court-appointed independent administrator was tasked with overseeing the compensation fund and managing the claims process. As part of the agreement, all pending litigation against MGM was dismissed.

Frantz publicly noted that while the settlement allowed victims to close this chapter, MGM carried an ongoing obligation to raise security standards across all its properties. He described the settlement as MGM 'stepping up and doing the right thing so victims can put this behind them once and for all.' CBS News reported the fund represented the third-largest victims compensation fund in U.S. history.

Individual distributions from the fund were determined through a separate process administered after the settlement closed. The case stands as one of the most significant premises-liability mass-casualty resolutions in federal court history.
