What happened

On August 8, 2023, a driver made an improper lane change on a Clay County, Missouri roadway and struck a nearby vehicle from the side. The plaintiff, whose identity was kept confidential throughout the matter, was in the vehicle that absorbed the impact.

At the scene, the plaintiff declined ambulance transport. He believed his discomfort was minor and expected it would resolve with rest and over-the-counter medication. Within a week, however, the pain had not subsided. He visited a chiropractor, underwent two weeks of treatment, then sought a second opinion at a different chiropractic practice. When neither round of care brought meaningful relief, he moved on to pain management and received a series of injections.

By the time the case was evaluated, the plaintiff carried documented medical bills of $161,471.39, with an additional $98,670.78 in written-off expenses. His injuries spanned his head, brain, neck, back, and spine, a cluster of conditions that affected daily functioning well beyond what a casual observer might expect from a sideswipe crash.

Laurie Del Percio of The Horn Law Firm in Independence took on the representation. Del Percio later noted that the central challenge was demonstrating the contrast between the plaintiff's life before and after the collision. Building that before-and-after picture, she said, was the key factor in reaching a successful outcome.

The case settled on March 4, 2026, for $300,000, without being formally filed in court. Past billed medical expenses totaled approximately $161,471.
