Family of Three Settles for $303,000 After Right-of-Way Crash Left Mother Facing Radius Surgery

On June 7, 2023, a Kansas City-area family was driving through Jackson County when another driver ran through an intersection without yielding the right of way and struck their vehicle. The force of the impact triggered the airbags. All three occupants, a mother, a father, and their infant child, were hurt.

The mother bore the most serious injuries. The collision displaced the head of her left radius, fracturing the bone at the elbow joint and sending pain down into her fourth and fifth fingers. She lost a significant range of motion in her left elbow and forearm. Surgery was required, followed by a course of occupational and physical therapy. Because she worked as a nurse, a job that depends on physical capability, the injury took her off the floor and out of work during her recovery period.

The father sustained softer-tissue injuries and accumulated just under $3,500 in medical expenses. The infant was not treated for physical injuries but experienced emotional trauma from the crash.

Attorney Laurie Del Percio of The Horn Law Firm, P.C. in Independence, Missouri represented all three family members. The case was filed in Jackson County Circuit Court. Del Percio built the damages picture around the mother's medical bills, which totaled roughly $88,586 billed and written off, as well as her lost nursing income during the recovery period. The father's and child's claims were joined in the same action.

The parties reached a settlement on February 1, 2025. The $303,000 total was allocated across all three plaintiffs: $275,000 to the mother, $22,000 to the father, and $6,000 to the child.
