On a stretch of westbound I-470 in the Kansas City metro, a driver came to a stop in congested traffic. The vehicle behind him did not slow down in time. The rear-end impact was violent enough to send the plaintiff's car into the concrete median and deploy the airbags.
The plaintiff, a restaurant manager who remained employed throughout his recovery, left the scene with injuries to his neck, right leg, chest, and ribs. Initial treatment gave way to an extended course of chiropractic care that included manual therapy, electrical stimulation, deep-tissue laser, intersegmental traction, and targeted exercises. Despite staying on the job, he faced lasting difficulty keeping up with household chores and yard work.
His past medical bills reached $104,007.05 (billed), with $58,553.57 written off through adjustments. Attorney Laurie Del Percio of The Horn Law Firm in Independence, Missouri, pursued the case in Jackson County Circuit Court. The liability insurer tendered its $100,000 policy limit, and Del Percio then pressed an underinsured motorist claim against the plaintiff's own carrier. A supplemental $1,000 in medical coverage brought the total to $266,000.
