About Daniel Dutko

Daniel Dutko is a partner at Kherkher Garcia with more than 20 years of trial experience and over 50 jury trials. He joined from Rusty Hardin & Associates, where he served as managing partner and head of personal injury litigation. In 2025, Daniel was lead trial counsel in Skaggs v. Angels Baseball, a wrongful death case against the Los Angeles Angels; during deliberations the jury sent a note asking about punitive damages, and the Angels settled the case for a confidential amount. He was also lead trial counsel in West v. Colorado Materials, representing the parents of an oilfield worker killed by a tractor-trailer; the jury returned a $46 million verdict in Hays County, the largest personal injury verdict in that county's history. In 2023, Daniel was appointed Special Prosecutor by the Texas House of Representatives for the impeachment trial of Texas Attorney General Ken Paxton. He earned his degree from Texas A&M University and his J.D. from South Texas College of Law Houston, where he was named Dean's Most Outstanding Student Advocate and inducted into the Order of the Barristers. Lawdragon has named him one of the 500 Leading Lawyers in America in 2025 and 2026.
