About Scott Hoy

Scott G. Hoy is the owner of Hoy Law and a lifelong resident of Sioux Falls, South Dakota. He earned his Bachelor of Science in 1981 and his Juris Doctor in 1984, both from the University of South Dakota. He was admitted to the South Dakota State Bar the same year.

Between 2008 and 2010, Scott completed extensive training to graduate from the Trial Lawyers College, the program run by Gerry Spence. He has nearly 40 years of trial experience, having litigated cases in state and federal courts with substantial appellate work before the South Dakota Supreme Court and the Eighth Circuit Court of Appeals. Scott is recognized by Super Lawyers and by the National Association of Distinguished Counsel as a member of the Nation's Top One Percent.

Verdict

In Hamer v. Duffy, 2026 SD 4, the South Dakota Supreme Court ruled unanimously that violations of the Federal Motor Carrier Safety Regulations adopted into state law can constitute negligence per se, reversing a zero-damages jury verdict and remanding for a new trial.
